had a car accident, dont think it was my fault but another person’s insurance company says it was!?
had a car accident with another person, i was pulling out from side road and tried to get on main road, i looked right before i pulled out but there was a SUV came up very fast, faster than I expected, so,,, we had a collision
He hitted me on my driver side, he’s front bumper was damaged, slightly
Two things, 1) I cancelled my insurance a week before the accident occured, coz i was about to sale the car and the car has already been sold now.
2) No witness at scene, No police at scence and No police involvement afterwards, No CCTV tape and No body injured.
Because I know my insurance company wont conver me up, so I paid for my cost entirely by myself, also, bcoz I worried about if I asks his insurance company to pay for my cost then I will have the fact of I had no insurance at that moment, be discovered and gives me legal trouble. So I didnt ask him to pay for my cost either. Em,,, if this makes sense.
However, two days ago I received a letter from he’s insurance company that asks me to cover he’s cost, about 1,400£!!! I seriously think I shouldnt pay for this, coz it wasnt my fault, I think the causation of collision is ‘he was driving too fast’
But the trouble is as I said, it is impossible for me to find any solid evidence to prove it was he’s fault.
Want ask: should I pay for his 1400£ cost? or should I stand on the court to fight? and if I stand to fight, what likely to happen?
After viewed couple of replies, I think I fully understand the situation now. Seems like that I have little ground to fight back
Anyway, let me adjust this question on this way: What is the best way to reduce potential cost?
What if I take the accusation and pay for he’s cost without any argument, is that enough to stop he’s insurance company from take this case to authority?!?!
I think I can pay 1400£ but I really dont want be troubled by the court, due to I had no insurance at that moment. I already sold the car n dont drive anymore, dont want be fined by court again ![]()

Well sounds like it was your fault. Cars on the main road always have the right of way. How do you know he was going to fast?
YOUR FAULT, you have NOTHING to stand on. He was going straight at an uncontrolled intersection, he gets to go as fast as he wants as far as fault is concerned. You were turning ON TO THE ROAD, you legally have to stop for him and have to make sure you have room before you turn on the road. You clearly didn’t have enough room, it’s not even like he rear-ended you. May sound like a lot of money, but you will have to pay it. Just be glad you aren’t getting a citation for driving without insurance as well.
That is one big reason we carry insurance. To represent our interests when sued unjustly. By cancelling your insurance too soon, you are now at the mercy of the other fellow’s insurance company. By your own account, however, it sounds as though the accident was your fault. And you are not likely to win it in court without evidence or representation.
Yes,it was your fault. You pulled out into oncoming traffic. If he takes you to court,the judge will find in his favor.
Fact. You did not have mandatory insurance which is against the law. Are you prepared to face up to that?
Fact. By paying for your own cost & keeping the accident under wraps gives the impression that you have guilt. That does not bode well for you.
Don’t throw yourself to the wolves. You are in for a bad time if you want to fight this out. You cannot prove that he was speeding & he was on the main road while you were moving out from a side road. He can claim that you were negligent turning out. No road skid photos or police records as proof. You have nothing to help you.
